Terms & Conditions - SBI Card Top-Up and Recharge Option

I/We agree to be bound by the terms and conditions as stated below;
  1. "SBI Card Top-up and Recharge Option" (Collectively "The Service Option") is a service set forth by SBI Card and Payments Services Private Limited ("SBICPSL") through its Service Provider INDIAIDEAS.COM LIMITED ("BillDesk") and is intended exclusively for SBI Credit Cardholders ("Cardholder").
  2. The Service Option is defined as a service/facility which enables online recharge facility for the services offered by the Service Providing Companies ("Companies") listed on the SBI Card Website. In order to avail The Service Option for the various services offered by the Companies, the Cardholder agrees to pay a convenience charge to SBI Card which convenience charge will be subject to revision/waiver promotions from time to time as may be decided by SBI Card at its sole option and discretion.There will be initially no convenience charges for any transactions done for Delhi- Gurgaon Expressway E-tag, Tata Sky, Vodafone prepaid connection services.
  3. "SBI Card Top-up and Recharge Option" is available only for select service providers as enrolled by BillDesk from time to time. Accordingly all responsibilities and consequent liabilities as regards the accurate and authentic service from the Service providing Companies shall vest with the Companies and BillDesk whether jointly, severally or otherwise as may be determined in accordance to law. Accordingly SBICPSL specifically disclaims any direct, indirect, incidental or consequential liabilities with regard to the foregoing matters and SBICPSL’S role for the purposes of this arrangement is only as a promotional entity. All matters are addressed to the Service providing Companies and BillDesk without reference to SBICPSL.
  4. Having regard to the preceding Clause 4 it is stipulated that the Cardholder agrees that he/she would enter the Bill details correctly in the designated fields on the webpage to which he/she will be directed on submission of Biller Name, Location.If entered incorrectly it will not be the responsibility of SBICPSL and any further disputes are to be settled with the service provider directly by the card holder. It is specifically stipulated that all liability shall be on the Cardholder in case of any incorrect entry and accordingly SBICPSL shall not be responsible in any manner for any such acts of the Cardholder.
  5. The Cardholder shall take precaution to ensure that no double Recharge is made from his end for the same bill.
  6. SBICPSL does not bear any responsibility for any late Reharge made by the Cardholder.
  7. The Cardholder should ensure that he/she receives a confirmation for the payment made by him/her through this facility. For any non-confirmation of the transaction, SBICPSL shall not be responsible and liable and accordingly no payments shall be made to the service provider Companies by SBICPSL on behalf of the Cardholder under any circumstances.
  8. Notwithstanding any other terms, it is stipulated that processing of all the Recharge is subject to the availability of free, clear and available limits in the cardholder's SBI Credit Card Account at the time of processing the transaction. In the event of credit limits not being available, cardholder will receive a Recharge failed report.
  9. In all situations where the Cardholder services by the Companies are discontinued/disrupted due to any acts of the service provider Companies, governmental orders, administrative directions and any other related matter, SBICPSLshall not be responsible and/or liable for the same and the Cardholder shall be solely responsible and liable to settle such matters with its service provider and/or relevant statutory authority.
  10. Having regard to the foregoing disclaiming stipulations, it is further covenanted that the Cardholder agrees and specifically indemnifies SBI Card from and against all actions, suits, claims, liabilities and proceedings due to or arising out of any or all disputes between the Cardholder and service provider Companies or by reason of SBICPSL acting in good faith and bonafide belief.
  11. SBICPSL through BillDesk will endeavor to effect recharge / carry-out instructions received by it within 2 working days of the attempt made by the Cardholder. However, SBICPSL does not warrant that fulfillment of instructions will not be delayed for reasons beyond its control including any default on the part of BillDesk or the Companies. As the instructions would depend on various electronic technology used from time to time, there could be delays in receipt of any instructions by SBICPSL from the cardholder and by BillDesk. er of Services. For all such delays and any matter connected therewith, BillDesk shall be responsible and liable being the owner and administrator of these services
  12. This service is available only for individual credit cardholders of SBICPSL and excluded its corporate credit cardholders.
  13. It is clarified here that credit cardholder statement is adequate and conclusive proof that such payment was made by SBICPSL to the service provider Companies by SBICPSL on behalf of the Cardholder and the Cardholder agrees to the same.
  14. There is no privity of contract between SBICPSL and the Cardholders as regards the contracts that may be executed between the Cardholder and the Companies providing the Service Options. Accordingly the Companies shall be solely responsible to the Cardholder to render the Services for which Recharge is to be made by the payment option mode of a SBICPSL issued Credit Card. As a consequence thereto, SBICPSL shall not be responsible/liable for any matter connected therewith including, but not limited to, deficient quality, delivery, quantity etc., and SBICPSL shall not be a proper or necessary party to any difference or dispute arising between the Cardholder, the Companies and BillDesk.
  15. Also the Cardholder shall not hold SBICPSL liable for any non-service, delayed service or faulty service rendered by the Companies or the Service administrator BillDesk and thereby the Cardholder shall not contact or communicate inter alia, by electronic mail, phone, post, SMS, or personal meeting with SBICPSL in this regard. SBICPSL shall not acknowledge any such communication.
  16. SBICPSL will not accept any cancellation request by the Cardholder if the payment transaction has been authorised on his card account and payment accepted by the Service provider Companies.
  17. Nothing contained herein shall prejudice or affect the terms and conditions of the Cardmember Agreement between the Cardholder and SBICSPL. These terms of the instant service shall be read in addition to and not in derogation to the terms contained in the Cardmember Agreement.
  18. Nothing contained in the said services shall be construed as binding obligation on SBICPSL or any participating Companies or service administrator BillDesk to continue the services after the services are terminated. This is additional facility made available by SBICPSL through BillDesk under definitive agreements between BillDesk and the Service Provider Companies.
  19. SBICPSL reserves the right to charge and recover from the Cardholder, fees for availing the service, which may be altered with prior intimation to the Cardholder.
  20. SBICPSL shall have the right to revoke and/or discontinue this service to certain Cardholders if it has reason and/or reasonable apprehension to believe that such continuing of this service shall gravely prejudice the commercial situation of SBICPSL. Such a determination by SBI Card shall be at its sole and absolute discretion with reference to its Cardholders. This Service is on best effort basis by SBICPSL
  21. All disputes and differences arising out and in connection with this service shall be subject to arbitration under the Arbitration and Conciliation Act, 1996 with any statutory amendments thereof. The arbitration proceedings shall be conducted by a sole arbitrator appointed by SBICPSL. The place of arbitration shall be New Delhi and language of arbitration shall be English. The award passed by the arbitrator shall be final and binding on parties. Existence of a dispute/difference shall not constitute a claim against SBICPSL. Notwithstanding the foregoing the courts in New Delhi shall have the exclusive jurisdiction to decide any matters related and connected to the instant terms.
  22. The said services will be effective subject to SBI Card Credit Card being valid and in good standing.
  23. SBICPSL Card acting through BillDesk may change from time to time the service provider Companies participating under this Service option with or without notice to the Cardholder.
  24. The Cardholder obligating Covenants:
    • The record of charges in respect of the said services received or availed by me and submitted by the service provider to my Card Account will neither bear my signature nor the imprint of my Card. I therefore undertake to unconditionally honor and pay without demur protest and contest all the said charges including interim charges booked by me under the said services, as and when I am billed for the same by SBICPL Card during the validity period of my Card and subsequent renewals thereof.
    • I/We understand that SBICPSL is not responsible or liable for any service and/or billing deficiencies or inadequacies of service provider as the case may be.
    • I/We hereby affirm that I/We am/are liable to honour all my credit card commitments irrespective of any grievances/complaints I may have with service providers.
    • I/We agree to resolve disputes (if any) of whatsoever nature directly with the service provider and will not hold SBICPSL liable for any deficiency of services provided by the service provider.
I hereby confirm my aforesaid obligations and agree to other terms contained herein.
