The following are the terms and conditions for use of the bill presentment, payment services ("Bill Payment Service") offered by IndiaIdeas.com Limited (hereinafter referred to as "BillDesk"). Please read them carefully. Access to and/or use of the BillDesk Bill Payment Services is subject to the following terms and conditions (the "Rules") as well as all applicable laws
BY COMPLETING THE REGISTRATION PROCESS OR BY MAKING/SCHEDULING A PAYMENT TRANSACTION, YOU ARE STATING THAT YOU AGREE TO BE BOUND BY ALL OF THESE RULES.
By accessing and using the BillDesk Bill Payment Service, You accept and agree to the Rules without limitation or qualification, and acknowledge that any other agreements You may have with BillDesk are superseded by the Rules, to the extent any conflict exists.
If You do not agree with these Rules, please do not use the Bill Payment Service.
The BillDesk Bill Payment Service Rules may be revised by updating this posting. You are bound by such revisions and should therefore visit this page to review the current Rules from time to time. In addition, please note that the BillDesk Bill Payment Service has a privacy policy that applies specifically to it.
The Bill Payment Services are offered by IndiaIdeas.com Limited. IndiaIdeas.com Limited is a leading provider of financial electronic commerce services in India. It offers its services under the brand label of 'BillDesk' and is today the preferred partner of choice for managing bill payment services among Banks and Billers in India.
Bill Payment Service (or 'the Service') refers to the bill presentment and/or payment services, online recharge/topup services and other services that may be offered from time to time by BillDesk, directly or in association with various partners (each feature individually and collectively referred to as the "Service" as the context may require).
User(s) refers to the eligible customer(s) of the Bill Payment Service.
Bank Account means a banking account maintained with a bank.
Biller refers to the person or entity who may present to the User some or all the details of the bill through the Service and/or also accepts payments made by the User through the Service.
Business Day means a day (other than Saturday or Sunday) on which banks in Mumbai are generally open for business.
Card means any valid credit card, debit card or prepaid card, which is used by You to carry out a Transaction and which You are lawfully authorised to use for the purposes of the Transaction.
Due Date refers to the date by which the Biller should receive the payment against the bill, invoice or order.
Issuer means any the bank /entity that has issued a Card.
Login ID means, where applicable, the login identity selected by the User during registration to personalise their identification as a registered User.
Participating Bank means a bank that allows payments to be made to a Biller using the internet banking facility of the bank.
Payment Account means a Card issued by an Issuer or a Bank Account maintained with a Participating Bank, both jointly and severally, as the context may require.
Payment Date refers to the date the Biller actually receives the payment towards the bill /invoice /order after due processing of the Payment Instruction issued by a User.
Payment Instruction refers to instruction given by the User using the Bill Payment Service for effecting payments to a Biller.
We, Us, Our, and and BillDesk Bill Payment are terms, which refer to the BillDesk Bill Payment Service.
You, Your and Yours refer to each person who uses the Bill Payment Service either by registering to use the Service or otherwise.
BillDesk means IndiaIdeas.com Limited and/or its subsidiaries, affiliates and assigns.
BillDesk Partner means a any person or entity working as an authorized business partner of BillDesk and through whom the Bill Payment Services are being availed by You.
BillDesk Website means any website that is owned or operated by BillDesk for the purposes of the Bill Payment Services.
In order to access and use the Bill Payment Service You must be an individual of at least 18 years of age who can enter into legally binding contracts under applicable law or a corporation, trust, association of persons or firm which can enter into legally binding contracts under applicable law. In case of a corporation, trust, association of persons or a firm, you must be authorised to agree to the Rules and to access, use and avail of the Bill Payment Service. If You do not qualify, please do not access or use the Bill Payment Service.
If you are not a resident Indian , you may access, use and avail of the Bill Payment Service only to the extent that the laws of India and those of Your country permit You to do so. Further, your use of the Service is based on the understanding and agreement that by accessing and using the Service, you may be violating the local laws in India and/or Your country. You agree that you will be solely and absolutely liable for any liability incurred by you in this regard and you will indemnify BillDesk against any liability incurred by us in this regard.
Access to and use of the Bill Payment Service may entail access/use of the BillDesk Website/application and is subject to all applicable local and international laws and regulations. Unless otherwise specifically indicated, You may download material displayed on any BillDesk Website for personal, non-commercial use only. You may not distribute, modify, copy, publish, transmit, display, sell, license, use, reuse or create derivative works of any of the contents of or material displayed on the BillDesk Website for any public or commercial purpose without the written consent of BillDesk or any third party BillDesk deems necessary. You must retain all copyright and other proprietary notices on downloaded and/or copied material. Any copy of material from the BillDesk Website You make and distribute for any purpose must also include these Rules. You may not access or use the BillDesk Website in any way that could or is intended to damage or impair the BillDesk Website, or any server or network underlying the BillDesk Website, or interfere with anyone else's use and enjoyment of the Website or the Bill Payment Services.
The BillDesk Service offers a convenient and secure way to make payments towards identified Biller(s) using a valid Payment Account.
Depending upon the BillDesk Business Partner through whom the Service is availed by You (i) the specific features of the Service may differ (ii) the number of Billers available over the Service can differ (iii) the type and range of Payment Accounts that can be used to issue a Payment Instructions can differ and (iv) the modes/devices over which the Service can be accessed can differ; and (v) the charges, fees for availing the Service or any aspect of the Service can differ. Specific details related to these aspects would be available with the BillDesk Business Partner or the channel over which the Service is being availed.
From time to time, BillDesk may, at its sole discretion, add to or delete from such list of Billers or types of Payment Accounts that can be used in respect of making payments to a Biller. In any event (i) the type and range of Payment Accounts that can be used for making payments may differ for each Biller depending on Biller specifications (ii) there may be an additional fees/charge when using certain types of Payment Accounts in respect of a Biller; and (iii) the terms upon which a payment can be made to a Biller can differ depending on whether a Card or a Bank Account is used to issue the Payment Instruction. Further depending on the specific facilities allowed by through a BillDesk Business Partner, payments to a Biller can be made either (a) by issuing a Payment Instruction for an online debit/charge to a Payment Account; or (b) by scheduling an automated debit to a Payment Account.
In order to use the Service, You may need to obtain access to the World Wide Web, either directly or through devices that access web-based content, and pay any service fees associated with such access. In addition, You must have all equipment necessary to make such connection to the World Wide Web, including a computer and modem or other access device.
BillDesk and/or the BillDesk Business Partner reserve the right to charge and recover from the User, fees for availing the Services. These changes shall be effective from the time they are posted on to the BillDesk Website or over the BillDesk Business Partner channel through which You are availing the Service. You are bound by such revisions and should therefore visit the BillDesk Website or check with the BillDesk Business Partner channel through which You are availing the Service to review the current fees from time to time.
In the event that You stop or seek a reversal of the Payment Instructions as may have been submitted, BillDesk shall be entitled to charge and recover You and You shall be liable to pay such charges to the Bill Payment Service as may be decided by BillDesk. These charges shall be charged on to Your designated Payment Account or in any other manner as may be decided by BillDesk.
In using the Bill Payment Service, You agree to:
(a) Provide true, accurate, current and complete information about yourself ("Registration Data"), Your Payment Account details ("Payment Data"), Your Biller details ("Biller Data") and
(b) maintain and promptly update the Registration Data, Payment Data and Biller Data to keep it true, accurate, current and complete. If You provide any information that is untrue, inaccurate, not current or incomplete, or BillDesk has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, BillDesk has the right to suspend or terminate Your account and refuse any and all current or future use of the Service (or any portion thereof).
You may, in some instances, be asked to open a User account for which You must complete the registration process. As part of such registration You may be asked to create a Login ID and a Password to facilitate subsequent access to the Bill Payment Service. Your password is intended to provide security against unauthorised access to and use of, Your Bill Payment Services account. You are responsible for maintaining the confidentiality of the Registration Data, Payment Data and Biller Data, and are fully responsible and liable for all activities that occur under Your password or account.
You agree that the Bill Payment Service is authorised to act on all instructions received when Your password is used in conjunction with Your Login ID. Any transaction or activity pursuant to use of Your account or password shall be deemed to be Your transaction or activity and there shall be no further obligation to verify the authenticity of any such transaction or activity. BillDesk does not assume any responsibility and cannot and will not be liable for any loss or damage arising from Your failure to comply with this section.
Notwithstanding anything stated elsewhere in the Rules, and despite correct use of Your User account and password, BillDesk shall be entitled in its sole discretion (but shall not be bound) to seek offline and/or additional written or other confirmation from You of any instruction, transaction or activity as BillDesk may deem fit.
In addition We may issue instructions from time to time intended to ensure the security of the Bill Payment Service. You agree to comply with those instructions.
Your Payment Instruction(s) will be effected only after proper authentication in accordance with the prescribed procedure of the Bill Payment Service. The Bill Payment Service starts the processing of Your Payment Instruction(s) on the basis of the Payment Data submitted by You.
Your submission of a Payment Instruction(s) from time to time shall constitute an irrevocable and unconditional authority for debiting the Payment Account(s) and making the payment to the Biller(s). Your Payment Instruction(s) will be effected only after proper authentication in accordance with the prescribed procedure depending upon the Payment Account used by you. It shall solely be Your responsibility to make the payment well in advance of the Bill Due Date (where applicable) so that the Bill Payment Service has sufficient time to process Your Payment Instruction(s) and make the funds available to the relevant Biller(s) by the Payment Date. If the Payment Date happens to be after the Due Date, You shall be liable to pay the delayed/late charges and/or for all other consequences as per the then existing policy of the Biller(s).
BillDesk assume no responsibility and shall incur no liability if it is unable to effect any Payment Instruction(s) owing to any one or more of the following circumstances: (i) If the Payment Instruction(s) issued by you is/are incomplete, inaccurate, invalid or delayed; (ii) If the Payment Account has insufficient funds/limits to cover for the amount as mentioned in the Payment Instruction(s); (iii) If the funds available in the Payment Account are under any encumbrance or charge. (iv) If your bank or card institution refuses or delays honoring the Payment Instruction(s); and (v) circumstances beyond the control of BillDesk (including, but not limited to, fire, flood, earthquakes, natural disasters, bank strikes, power failures, systems failure like computer or telephone lines breakdown due to an unforeseeable cause or interference from an outside force).
If the Bill Payment Service fails to effect the Payment Instructions on/before the Payment Date for any reason other than the reasons mentioned above and such failure is directly and solely attributable to BillDesk, then in such an event, the liability of BillDesk shall be restricted to late payment charges, if any, subject to the maximum of Rs 100/- per bill. Under no circumstances shall BillDesk and/or any of their respective officers, directors, employees or agents shall be liable for any indirect, incidental, consequential or punitive damages, or for loss of profit, revenue, even if advised of the possibility of those damages except to the extent as mentioned above.
Notwithstanding anything stated elsewhere in the Rules, BillDesk shall be entitled, in its sole and absolute discretion, to refuse to comply with all or any of Your instructions without assigning any reason.
When You initiate a payment and/or issue a Payment Instruction:
Your bill remains unpaid when a Payment Instruction issued or instructed by You is declined by the card Issuer or Participating Bank; in all such cases You will be responsible for any additional fees and charges levied by either Your financial institution or Biller and You will remain responsible to pay Your bill to the Biller.
As a condition of Your use of the Service, You warrant to BillDesk that You will not use the Service for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You agree to abide by all applicable local, state, national and international laws and regulations and are solely responsible for all acts or omissions that occur under Your account or password, including the content received and payments made through the Service. By way of example, and not as a limitation, You agree not to:
BillDesk has no obligation to monitor the Service or any User's use thereof or retain the content of any User session. However, BillDesk reserves the right at all times to monitor, review, retain and/or disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request.
You should assume that everything on the BillDesk Website and also in respect of the Bill Payment Service is copyrighted unless otherwise noted and that it must not be used except as provided in the Rules or with the express written consent of BillDesk or any third party BillDesk deems necessary. BillDesk neither warrants nor represents that Your use of the material displayed in the use of the Bill Payment Services site will not infringe rights of third parties. Any product, service, program, or technology described on the BillDesk Website and in respect of the Bill Payment Service may be the subject of other intellectual property rights (including but not limited to copyright, trademark, or patent rights) owned by BillDesk. Any such right that is not expressly licensed herein is reserved by BillDesk.
Any product, service, program or technology described in any document published by BillDesk on the BillDesk Website or as part of the Bill Payment Service may be the subject of other intellectual property rights owned by BillDesk. Any such right that is not expressly licensed hereunder is reserved by BillDesk.
The trademarks, logos and service marks, whether registered or unregistered (collectively the "Trademarks") displayed in the use of the Bill Payment Service may be the Trademarks of their respective owners in India and other countries. Nothing contained in the offer of the Bill Payment Service should be construed as granting by implication, estoppel, or otherwise, any license or right to use any Trademark displayed in such Services without the written permission of BillDesk or such third party that may own the Trademark. Misuse of any Trademarks, or any other content, displayed in the Bill Payment Services is prohibited. BillDesk and/or the owners of the Trademarks aggressively enforce their intellectual property rights, including via civil and criminal proceedings.
Any communication or material You send in respect of the Bill Payment Service or to the BillDesk Website, electronically or otherwise, including, but not limited to, data, questions, comments, suggestions, or submissions, is and will be treated as non-confidential and non-proprietary, unless otherwise stated.
Anything You send to the BillDesk Website or to the Bill Payment Service may be used by BillDesk for any purpose including, but not limited to, reproduction, transmission, disclosure, publication, broadcast, and posting. By submitting material to the BillDesk Website or to the Bill Payment Service You irrevocably transfer and assign to BillDesk, and forever waive and agree never to assert, any copyrights, "moral" rights, or other rights that You may have in such material. BillDesk is free to use, without obligation of any kind, any ideas, concepts, techniques, or know-how contained in any communication You send to BillDesk for any purpose whatsoever, including, but not limited to, developing, manufacturing, and marketing products and services.
By using the Bill Payment Service, You may submit, or We may gather, certain limited information about You and Your usage of the Service. Subject to it being otherwise stated, we are free to use such information for any purpose it deems appropriate.
The information and services provided or referenced in the Bill Payment Services and over the BillDesk Website are provided "as is" and with all faults, and the entire risk as to satisfactory quality, performance, accuracy and effort is with the User. This means that although reasonable efforts are made to include accurate and up-to-date information in respect of the Bill Payment Service, BillDesk make no warranties or representations as to its accuracy. BillDesk makes no warranty, either express or implied, that any information or service provided or referenced in the Bill Payment Services site is either merchantable or accurate, that such information or service will fulfill any of Your particular purposes or needs, or that such information or service does not infringe on any third party rights. BillDesk may periodically add, change, or improve any of the information, products, services, programs, and technology described in the BillDesk Website or in respect of the Bill Payment Services without notice. BillDesk assume no liability or responsibility for any errors or omissions in the content of the Bill Payment Services.
Notwithstanding Our efforts to ensure that the Bill Payment system is secure, You acknowledge that all electronic data transfers are potentially susceptible to interception by others. We cannot, and do not, warrant that data transfers utilising the Bill Payment Service, or electronic mail transmitted to and from Us, will not be monitored or read by others.
Your use of the Bill Payment Service or the BillDesk Website is at Your own risk. To the maximum extent allowed by law, BillDesk nor any other party involved in creating, producing, or delivering the Bill Payment Services, will be liable for any direct, indirect, incidental, consequential, or punitive damages (including, without limitation, lost profits, cost of procuring substitute service or lost opportunity), however caused, arising out of Your access to, use of, or reliance on the Bill Payment Services, even if BillDesk has been advised of the possibility of such damages. Without limiting the foregoing, BillDesk assumes no responsibility for, and will not be liable for any damages relating to or caused by any viruses which may affect Your computer equipment or other property on account of Your access to, use of, or downloading from, the BillDesk Website. BillDesk cannot and does not guarantee continuous, uninterrupted or secure access to the Bill Payment Services.
You agree to indemnify and hold BillDesk, its subsidiaries, affiliates, officers, agents, co branders or other partners and employees, harmless from any claim, demand, or damage, including reasonable attorneys' fees, asserted by any third party due to or arising out of Your use of or conduct on the Service.
BillDesk may provide or third parties may provide, links to other sites or resources ("Linked Sites"). BillDesk has not reviewed all of the sites that are linked to the BillDesk Website or the Bill Payment Service and the fact of such links does not indicate any approval or endorsement of any material contained on or transmitted from any linked site. BillDesk is not responsible for the contents of any site linked to the Bill Payment Service.
Your correspondence or business dealings with, or participation in promotions of advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between You and such suppliers. BillDesk shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource. The links have been provided to You only as a convenience and the inclusion of any link does not imply any association of the Bill Payment Service with the operators of such sites or resources. Your connection to and use of any such linked site is at Your own risk.
These Rules remain in effect until Your use of the Bill Payment Service is terminated by You or by Us. You may terminate Your use of, and participation in the Bill Payment Service for any reason at any time. Termination must be effected by following the process set out on Our website or the BillDesk Business Partner channel through which You are availing the Service.
BillDesk may terminate or suspend performance of these Rules and the Bill Payment Service for any reason at any time. We may attempt to notify You in advance, but We are not obliged to do so. BillDesk may, in its sole discretion, with or without notice, terminate Your password, account (or any part thereof) or use of or access to the Service, and may modify, remove or discard any content/bills/data within the Service, for any reason, including, without limitation for lack of use or if BillDesk believes that You have violated or acted inconsistently with the letter or spirit of the Rules. Further, You agree that BillDesk shall not be liable to You or any third-party for any termination of Your access to the Service.
Termination of Your use of, or participation in the Bill Payment Services shall not relieve You of any responsibility to pay outstanding fees or charges or other liabilities incurred prior to the date of termination. After termination You cannot make further use of the Bill Payment Service and You must make alternative payment arrangements for unpaid bills.
In respect of the Bill Payment Service notice or other type of communication may be addressed to You:
(a) by electronic mail ("e-mail") to the e-mail address that You have registered while availing the Service;
(b) by making the notice available for access on the BillDesk Website, or
(c) by ordinary pre-paid mail to Your address registered while availing the Service.
Any notice given by Us to You shall be deemed given:
(a) at the time when an e-mail message is sent by Us;
(b) on making the notice available for access on the BillDesk Website for display to You;
(c) 2 Business Days after entry of mail into the mail stream.
You are responsible for keeping Your e-mail or physical (street) address that You may have provided in availing the Services up-to-date, if and when they change.
BillDesk may be required to provide to You certain disclosures and notices, which are mandated by various laws and rules and transaction related notifications such as receipt of bill details, payment advices, payment return advices etc. You acknowledge and agree to receive all such disclosures and notifications electronically, which, in most cases, will be done through the Internet or over the mobile phone. If, for any reason, You do not wish to receive the disclosures electronically, You must advise the Bill Payment Service immediately. In such an event, BillDesk reserves the right to discontinue/terminate the provision of the Service to You, in whole or in part.
You acknowledge that the read-out, faxed, email or printed output, if any, that is generated at the time of operation of Your account under the Service is a record of the operation by You. The records of the Bill Payment Service, generated by the transactions arising out of the use of the Service, including the time the transaction is recorded shall be conclusive proof of the genuineness and accuracy of the transaction.
You acknowledge that BillDesk shall have no liability or obligation to keep a record of the transactions carried through the Bill Payment Service and/or to provide information to You or for verifying Your Payment Instructions, other than records required to be kept or information required to be provided statutorily by BillDesk.
You acknowledge that the Bill Payment Service does not pre-screen the data presented by Biller(s) but that Bill Payment Service shall have the right (but not the obligation) in its sole discretion to refuse or curtail any content/data that is available via the Service. Without limiting the foregoing, BillDesk shall have the right to remove any content/data that violates the Rules or is otherwise in violation of any contract entered into by BillDesk. You agree that You must evaluate, and bear all risks associated with, the use of any content/data, including any reliance on the accuracy, completeness, or usefulness of such content/data.
The Laws of India shall govern the validity, construction and enforceability of this Agreement in all respects. You agree to submit to the personal and exclusive jurisdiction of the courts located within Mumbai, India, to the exclusion of all other Courts, as regards any claims or matters arising under these terms and conditions. BillDesk accepts no liability whatsoever, direct or indirect for non-compliance with the laws of any country other than that of India. The mere fact that a user of the Bill Payment Service or the BillDesk Website in a country other than India accesses the site or the service does not imply that the laws of that country govern these terms and conditions or the operations in the accounts of the users of this Service. Use of the Service is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph.
Any failure, delay or omission by BillDesk to enforce any of its rights under the Rules or applicable laws shall not constitute a waiver of such right. If any part of these Rules are determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
You agree to follow any applicable laws in Your use of the Bill Payment Service. You will abide by these laws and regulations as applicable and will not transfer, directly or indirectly, by electronic transmission or otherwise, any content or software from the BillDesk Website to or from any countries or foreign nationals in violation of such laws or regulations.
Please note that these Bill Payment Services are offered by IndiaIdeas.com Limited and not the various financial institutions that issue/maintain Card or Bank Accounts.
